Comparison of California and Federal Leave and Disability Laws

All HR personnel should understand the differences between the various state and federal leave acts. In recent months, new regulations were issued interpreting the federal Family Medical Leave Act (FMLA). Also, Congress passed the new Americans with Disabilities Amendments Act (ADAAA). With the new changes, there are significant differences between federal and California leave and disability laws. Employers should not assume that compliance with the California Family Rights Act and the Fair Employment and Housing Act will result in automatic compliance with the FMLA and the ADAAA. The California Fair Employment and Housing Commission has prepared two tables comparing the salient provisions of the competing statues.
